Cases involving the possession of narcotic and psychotropic substances are conducted under the ustawa o przeciwdziałaniu narkomanii (Act on Counteracting Drug Addiction). They carry real penalties, but Polish law also provides solutions that allow a case to be concluded without a conviction. Discontinuance of proceedings - art. 62a

Where the subject of the act is an insignificant quantity of a substance intended for personal use, and imposing a penalty would serve no purpose, the proceedings can be discontinued, even before an order to open an investigation is issued. This is one of the most important defence tools in cases of this type. We assess whether it can be used in your situation, taking into account the quantity, the type of substance and the circumstances of the detention.
